ABOUT THE INVESTMENT COUNCIL UNDER THE HEAD OF ADMINISTRATION

CITIES OF ROSTOV-ON-DON

In accordance with the decree of the Administration of the Rostov region of December 22, 2010 N 390 "On the creation of the Investment Council under the Head of the Administration (Governor) of the Rostov region", in order to attract and effectively use budget and private investments for the development of the economy and social sphere of the city of Rostov-on I decree to Don:

1. Create an Investment Council under the head of the Administration of the city of Rostov-on-Don.

2. To approve the Regulation on the Investment Council under the head of the Administration of the city of Rostov-on-Don according to the appendix.

3. To consider as invalid:

• order of the Mayor of Rostov-on-Don from 19.02.2009 N 43 "On the creation of a working group to support investment projects";
• Order of the Mayor of Rostov-on-Don from 18.09.2009 N 366 "On amendments to the order of the Mayor of Rostov-on-Don dated 19.02.2009 N 43".

4. This resolution comes into force from the moment of its official publication in the city newspaper "Official Rostov".

5. Control over the implementation of the resolution shall be entrusted to the Deputy Head of the Administration of the city of Rostov-on-Don (on economic issues) Razdorskiy SA.

1. General Provisions

1.1. The Investment Council under the head of the Administration of the city of Rostov-on-Don (hereinafter referred to as the Council) is a permanent collegial advisory body designed to facilitate the implementation of investment projects and attract investment to the economy of the city of Rostov-on-Don. The Council implements the policy of the Administration of the city of Rostov-on-Don to create a most-favored-nation treatment for subjects of investment activity in order to reasonably observe the economic, social and environmental interests of the population of the city of Rostov-on-Don, to ensure sustainable economic development, a stable social situation and a favorable environment.

1.2. The Council in its activities is guided by the Constitution of the Russian Federation, federal laws, decrees and orders of the President of the Russian Federation, decrees and orders of the Government of the Russian Federation, regional laws, decrees and orders of the Governor of the Rostov Region, decrees and orders of the Government of the Rostov Region, decisions of the Rostov-on-Don city Duma, resolutions and orders of the Administration of the city of Rostov-on-Don, these Regulations.

1.3. The composition of the Council is formed from the number of deputy heads of the Administration of the city of Rostov-on-Don, representatives of sectoral (functional) local government bodies, structural divisions of the Administration of the city of Rostov-on-Don, organizations of the city of Rostov-on-Don.

The council is headed by the head of the Administration of the city of Rostov-on-Don.

The composition of the Council is approved by a legal act of the Administration of the city of Rostov-on-Don.

1.4. Meetings of the Council are held at least once a quarter.

2. Goals and objectives of the Council

2.1. The Council is created in order to:

• implementation of the policy of attracting investments into the economy of the city of Rostov-on-Don;
• developing solutions that contribute to the successful implementation of investment projects;
• increasing the efficiency of interdepartmental coordination of work on the implementation of investment projects;
• development of decisions on issues of interaction between sectoral (functional) bodies, structural divisions of the Administration of the city of Rostov-on-Don and investors.

2.2. The main tasks of the Council are:

• determination of common positions of sectoral (functional) bodies and structural divisions of the Administration of the city of Rostov-on-Don in relation to the implementation of investment projects;
• developing recommendations and making proposals for the adoption and improvement of regulatory legal acts that promote effective investment activities;
• making proposals for resolving controversial issues in the implementation of investment projects;

• making proposals for the conclusion of investment agreements;
• assistance in the settlement of financial and property problems between the parties - responsible structures for the implementation of investment projects and their participants in the event of an investment agreement;

• consideration of issues related to the development of the investment strategy of the city of Rostov-on-Don, proposals for its adjustment;

3. Rights and obligations of the Council

In order to fulfill its functions, the Council has the right:

3.1. Request and receive from industry (functional) bodies, structural divisions of the Administration of the city of Rostov-on-Don, other organizations and participants in investment projects, the necessary documents and information on the implementation of investment projects.

3.2. To invite and hear at a meeting of the Council representatives of organizations participating in the implementation of investment projects, as well as persons whose interests are affected during the consideration of issues.

3.2.1. If necessary, involve representatives and specialists of public utilities organizations, consulting agencies, territorial design and research organizations for the consideration of investment projects (proposals).

3.3. Request from the sectoral (functional) bodies, structural divisions of the City Administration motivated conclusions on the importance of the implementation of the investment projects under consideration.

3.3.1. Based on the results of consideration of the investment project, make a decision on the effectiveness of the investment project and on the expediency of support by the Administration of the city of Rostov-on-Don with the implementation of this investment project

3.3.2. Assign monitoring of the implementation of decisions made by the Council to the members of the Council.

3.3.3. To bring the decision of the Council on the effectiveness of the investment project to the attention of the Administration of the city of Rostov-on-Don in order to consider the issue of providing a land plot.

3.4. To organize expert councils, working groups under the leadership of the deputy heads of the Administration of the city of Rostov-on-Don to address issues within the competence of the Council, in sectoral areas of activity.

3.5. Ensure the interaction of investors with industry (functional) bodies, structural divisions of the Administration of the city of Rostov-on-Don and supervisory authorities in the implementation of investment projects.

3.6. Recommend the preparation of municipal regulatory legal acts of the Administration of the city of Rostov-on-Don on issues related to attracting investments.

 

4. Rules of Procedure of the Council

4.1. Meetings of the Council are chaired by the Chairman of the Council, and in his absence - by one of the Deputy Chairmen of the Council.

4.2. The Chairman of the Council performs the following functions:

• directs the activities of the Council;
• holds meetings of the Council;
• submits for discussion issues related to the activities of the Council.

4.3. The Secretary of the Council performs the following functions:

• organizes work on the preparation of meetings of the Council;
• invites members of the Council to meetings of the Council;
• invites representatives of investors, as well as persons whose interests are affected when considering issues at a meeting of the Council;
• forms the agenda of the Council meeting, taking into account the instructions of the Chairman of the Council or one of the Deputy Chairmen of the Council on the basis of proposals from members of the Council, sectoral (functional) and territorial bodies of the Administration of the city of Rostov-on-Don, as well as investors;
• provides the members of the Council with materials on the issues discussed on the agenda of the Council meeting;
• draws up and sends the signed minutes of the Council meeting to the Council members and persons invited to the Council meeting.

4.4. The decision to hold a meeting of the Council is made by the Chairman of the Council, and in his absence - by one of the Deputy Chairmen of the Council on the basis of proposals from the members of the Council.

4.5. A meeting of the Council is competent if it is attended by at least half of its members, including the Chairman of the Council, and in his absence - one of the Deputy Chairmen of the Council.

4.6. Each member of the Council has one vote.

4.7. On the issues considered at the meetings, decisions of the Council are made, which are of a recommendatory nature, which are drawn up in minutes. The minutes are signed by the Secretary and approved by the Chairman of the Council or one of the Deputy Chairmen of the Council.

4.8. Council decisions are taken by a simple majority of votes of the Council members present at its meeting. In case of equality of votes, the chairman of the Council, and in his absence one of the vice-chairmen of the Council, has the right to vote.

4.9. The agenda of the Council meeting is formed on the basis of proposals from the Council members.

4.10. Organizational, methodological and informational and analytical support of the Council's activities is carried out by the Department of Economics of the city of Rostov-on-Don.
